An Abuja Federal High Court on Friday refused to hear the application for stay of execution brought before it by the embattled Abia State
Governor, Okezie Ikpeazu has failed in his bid to be granted stay of execution over the lingering face-off between him and his close contender, Dr. Uche Ogah.
In his ruling on Friday, Justice Okon Abang of the Federal High Court referred the both to Court of Appeal for resolution.
Recently, Ikpeazu, under the jurisdiction of the same court presided over by Justice Abang was sacked as governor of the state over allegation bordering on tax evasion.
Ogah who came second at the 2014 Peoples Democratic Party, PDP, primaries, in the state declared the winner of the exercise.
Abang also ordered the Independent Electoral Commission, INEC, to issue Ogah with certificate of return which was subsequently effected by the electoral umpire.
Following the court’s ruling, Ikpeazu filed for stay of execution seeking the court to set aside its earlier decision.
Today’s ruling was initially slated for Thursday 4th July, 2016 by the court but for the public holiday.
The ruling also came shortly after Mr. Friday Nwosu’s application, which was filed in the same instance, was struck out by the court for lack of proof.
